1. Agreement to these terms
By creating an account or using Camspect's website, web app or mobile apps (the "Service"), you agree to these terms and to our Privacy Policy. If you use the Service for a company, you agree on its behalf and confirm you have the authority to do so; "you" then means that company.
If you don't agree to these terms, don't use the Service.
2. Accounts and workspaces
Each company has a workspace. Its admins invite users and decide what each user can access. You're responsible for the activity in your workspace, for keeping passwords and API keys safe, and for telling us right away about any unauthorized use.
You must give accurate information when you sign up and keep it up to date.
3. Free trial, subscriptions and billing
New workspaces start with a free trial of 30 days. To keep using the Service after the trial, an admin chooses a paid plan. Plans are billed per active user, monthly or annually, in advance, and renew automatically until cancelled.
Prices and the number of users billed are shown in the app before you pay. If a payment fails or a subscription ends, we may pause access to the workspace until it's renewed. Your content stays in the account while it's paused.
Fees don't include taxes, which you're responsible for. Except where the law requires otherwise, fees already paid aren't refundable.
4. Your content
You own the photos, videos, documents, notes and other content you put in the Service ("your content"). You give us permission to host, store, copy, process and display your content only as needed to run, secure and improve the Service and to do what you ask, for example creating reports or share links.
You're responsible for your content and for having the rights and consents it needs, including from property owners and anyone who appears in your photos.
When you share content through a link, publish it to a portfolio or send a report, anyone with access can see it. You can stop sharing at any time where the Service allows it.
5. Acceptable use
You agree not to:
- break the law, or infringe anyone's rights, including privacy and intellectual property;
- upload malware or content that is illegal, harmful or deceptive;
- try to access accounts, projects or data you're not permitted to see;
- disrupt, overload or probe the Service, or get around its limits or security;
- copy, resell or reverse engineer the Service, except where the law allows it;
- use the API beyond its documented use or rate limits.
We may suspend accounts that break these rules, and will tell you when we reasonably can.
6. AI features
Some features use AI to draft content or answer questions. AI output can be wrong or incomplete, so review it before you rely on it, for example before you send an inspection to a client.
7. Changes to the Service
We keep improving Camspect, so features may change. If we remove something important you pay for, we'll give you reasonable notice. Some features depend on third party services and may change when those do.
8. Cancellation and termination
An admin can cancel the subscription at any time; it ends at the end of the current billing period. We may suspend or end access for serious or repeated breaches of these terms. After an account ends, you can ask us for an export of your content within a reasonable time, after which we may delete it.
9. Disclaimers
The Service is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Camspect is a documentation tool and doesn't replace professional judgment, inspections or advice.
10. Limitation of liability
To the extent the law allows, Camspect won't be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim about the Service is limited to the amount you paid us in the 12 months before the claim.
11. Indemnity
You'll defend and hold Camspect harmless from claims arising from your content or your breach of these terms, to the extent the law allows.
12. Governing law
These terms are governed by the laws of the place where Camspect is established, without regard to its conflict of law rules. If a part of these terms can't be enforced, the rest stays in effect.
13. Changes to these terms
We may update these terms. If a change is significant, we'll tell you by email or in the app before it takes effect. Continuing to use the Service after that means you accept the new terms.
